1. Acceptance of Terms

By accessing or using the eyeq.ai platform ("Service"), operated by Sebastian Kielmann ("Operator", "we", "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service.

2. Description of Service

eyeq.ai is a Generative Engine Optimization (GEO) platform that monitors how brands, companies, products, and services are represented in AI-generated responses from large language models including but not limited to ChatGPT, Claude, and Gemini. The Service provides AI visibility tracking, citation analysis, hallucination detection, competitor benchmarking, and actionable optimization recommendations.

3. Eligibility & Registration

The Service is available to businesses and individuals who are at least 18 years of age. Access is currently limited to invited users during the private beta phase. By requesting an invitation, you represent that the information you provide is accurate and complete.

4. User Accounts

Upon receiving access, you are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations.
• Attempt to gain unauthorized access to other users' accounts or data.
• Interfere with or disrupt the Service infrastructure.
• Scrape, crawl, or automated-access the Service beyond its intended use.
• Resell, redistribute, or sublicense access to the Service without prior written consent.
• Use the Service to harass, defame, or infringe upon the rights of any third party.

6. Intellectual Property

All content, software, designs, logos, and trademarks associated with eyeq.ai are the property of the Operator or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without explicit written permission.

7. Data & Content Ownership

You retain ownership of any data you submit to the Service (e.g., domain URLs, company information). You grant us a limited license to process this data solely for the purpose of providing the Service. AI-generated analysis results and reports are generated by the Service and may be used by you for internal business purposes.

8. Third-Party AI Services

eyeq.ai queries third-party AI services (OpenAI, Anthropic, Google) as part of its analysis. We do not control the responses generated by these services. The AI-generated content analyzed by our platform reflects the output of those third-party models and should not be considered as statements or endorsements by eyeq.ai.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, or reliability of any AI-generated analysis or recommendation.

10. Limitation of Liability

To the fullest extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after modifications constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.
